Our Recruitment Fees, Terms and Conditions

A. Recruitment Fee
The fee is a once only fee, is not an annual fee, and only the employer is liable to pay the fee.

The recruitment fee is 11% of the employee’s expected annual remuneration package plus GST.

Other expenses incurred such as travel and accommodation (if required) are invoiced at cost price or a negotiated rate.

B. Annual Remuneration Package

The annual remuneration is the package comprising the base salary plus expected incentives, commissions and bonus’, plus additional benefits such as a motor vehicle (notional value $12,000), accommodation, and superannuation.

C. Replacement Guarantee

The replacement guarantee commences on the date the successful applicant commences employment. The period is 3 months for annual remuneration packages under $40,000, and 4 months for packages in excess of $40,001. The guarantee period applies from the commencement date of the successful applicant. Should an employee who is engaged through The Retail Resources Company leave the employment due to either parties dissatisfaction within the guarantee period they will be replaced free of charge provided the recruitment fee is paid within fourteen (14) days of the invoice date, there are no other outstanding monies owed to The Retail Resources Company, and The Retail Resources Company are notified within the guarantee period.

The Retail Resources Company must be given the opportunity to replace the original applicant. If no suitable applicant can be found, no refund is given, however a credit of 50% of the value of the original recruitment fee will be raised and held for 12 months. The replacement guarantee is not applicable when the employee has left because of redundancy or company restructuring and the guarantee covers one employee only. The replacement guarantee is for the same position as the original assignment and any change in the remuneration, hours or conditions may cause the replacement guarantee to be invalid.

D. Advertising

Advertising is recommended for most assignments. The Retail Resources Company will compose and pay for an advertisement on an internet employment website. Should newspaper display advertising be required then the costs of such advertising (including GST) will be invoiced to the client. With display advertising we will compose the advertisement and insert it following the client’s approval. Should no engagement be made, the client will still be invoiced for the cost of the advertising (including GST).

Should display advertising be required for re-hiring under the replacement guarantee, the cost (including GST) will be invoiced to the client.

E. Additional Testing

Should additional testing such as psychological profiles be required then the costs (including GST) of such tests will be invoiced to the client.

F. Failure to Arrange Employment

Should the client not engage an employee within 12 weeks (or a date specified), then the assignment will be deemed to be unsuccessful and no fee will be charged unless stated elsewhere in these terms and conditions.

G. Exclusivity Clause

The Retail Resources Company undertakes recruitment assignments with its clients on an exclusive basis and does, in principal, only charge a fee when the assignment concludes with a successful placement. It is anticipated that once an assignment commences it will conclude with a satisfactory placement and The Retail Resources Company will receive a full fee. Any internal applicants or applicants who approach the client direct are to be referred to The Retail Resources Company. Should the position have been previously advertised, the client is to supply the names of the unsuccessful applicants to The Retail Resources Company.

H. Cancellation of Services Fee:

An assignment commences at the time The Retail Resources Company are given instructions by the client to commence the assignment and a Confirmation of Services letter is raised and forwarded to the client. The forwarding of this letter will constitute an unconditional acceptance by the client of these terms and conditions.

If the assignment is terminated by the client prior to a placement being made, an invoice will be raised to recover the cost of advertising (if any), plus 50% of the applicable recruitment fee if at first interview stage, or 60% if at second interview stage, or 70% if at client interview stage. Because of the dynamic nature of recruitment where suitable applicants may secure alternate employment should a postponement occur, a postponement of the assignment by the client is regarded as a termination of the assignment and will incur the appropriate cancellation fee.

I.  Multiple Engagements

The multiple engagement clause provides a lower fee for clients wishing to employ more than one person for a particular position category during the same recruitment assignment. The Multiple Engagement clause is only applicable when the client selects more than one applicant from the original shortlist provided. Should this not occur and The Retail Resources Company have to “ re-commence” the assignment to fulfil the positions, then the Multiple Engagement clause will cease to apply and future successful applicants will attract full fees.

The fee for the first successful applicant to be placed is 11% of the annual remuneration package, and the fee for the second and subsequent applicants placed is 7% of the annual remuneration package. The replacement guarantee for the first successful applicant placed is 3 months for annual remuneration packages under $40,000, and 4 months for packages in excess of $40,001. The replacement guarantee for the second and subsequent applicants placed is 2 months for annual remuneration packages under $40,000, and 3 months for packages in excess of $40,001.

J.  Invoice Date and Payment

Invoices will be dated at the date the new employee is appointed and payment is due fourteen (14) days from the invoice date.  The appointment date is the date the successful applicant is advised of their appointment and is not their commencement date. If payment is not received within this period the replacement guarantee will be invalid.

K.  Cost Recovery

Any expenses, costs or disbursements incurred by The Retail Resources Company in recovering any outstanding monies including debt collection agency fees and solicitor’s costs shall be paid by the client, providing that those fees do not exceed the scale of charges as charged by that debt collection agency/solicitor and in any event the commission is not to exceed 18% of the debt value, plus out of pocket expenses.

L.  Future Engagements

Should any applicant introduced formally or informally by The Retail Resources Company be engaged within 12 months of the date of referral, then an invoice will be raised by The Retail Resources Company for the fee applicable at the date of the referral.

Additionally, if the client passes on to another employer an introduction of an applicant introduced by The Retail Resources Company, and that applicant is engaged within 12 months of the date of referral, then an invoice will be raised by The Retail Resources Company for the fee applicable at the date of referral.

M.  Indemnity

All care is taken to screen applicants, check references, and to provide only quality applicants to the client, however, The Retail Resources Company accepts no responsibility for incorrect information supplied or any decisions made based on that information.

Following the engagement of an applicant introduced by The Retail Resources Company, the employer has full responsibility for that employee and The Retail Resources Company accepts no liability for any actions, loss or damage.
